Who is at fault in this situation?

A garbage collector sued his employer when he was struck by a motor vehicle and became injured during the course of his work. The accident occurred when the garbage collector ran out from behind a garbage truck while carrying a garbage bin. The work was being carried out in darkness and a ping motorist, driving at about 60-70 kilometres per hour, failed to see the garbage collector and knocked him down. The garbage truck was also illuminated.
